It’s Time to Update Your Governing Documents

Please note, this time of year many associations consider amending and updating their governing documents. It is extremely important that every homeowners’ association document be reviewed to determine that they have not expired.

Homeowners’ association documents may be affected by the operation of the Marketable Record Title Ac (MRTA), which is Chapter 712, Florida Statutes. MRTA can extinguish certain documents (DECLARATION) that are 30 years or more old.

It is important  for associations to periodically review the community’s governing documents with an attorney. While your condominium documents are probably not invalid, they could be ancient in practice and not harmonious statutory provisions.
